TERMS OF SERVICE
LAST UPDATE: Jan. 2026This contract applies to the artist (me) further called Seller and person or institution further called Customer (you) purchasing from Seller a 3d model further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay in full before receiving the product.
2. Customer can pay upfront or in installments. At least a 25% upfront installment is needed. Rest of installments must be at least of 25%.
3. Any other payment schedule has to be mutually agreed before work on the Product commences.
4. Customer accepts that work on the Product will not commence until at least the first upfront payment has been received by Seller according to the above schedule.
5. Certain types of work do not allow for a split payment. In such cases customer will be informed about this and will be asked to agree on a different payment schedule, before any work can commence.PRODUCT DELIVERY
6. Customer agrees that Product will be delivered digitally via download link to email address provided by Customer, discord message or similar, after the final payment has been received by the Seller.6b. Customer agrees that if paying in installments, the Product development progress will match the pace of payments (at 4 installments of 25% each maximum). This will affect the product delivery timeframe. See section 14b
7. It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
7b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer loses their files.REVISIONS
8. Customer has the right to be informed and shown progress of the product, and to provide feedback for changes and revisions about it.
9. Customer has the right to a reasonable amount of minor edits along the progress, such as changing some colors or altering a small detail. Any requests above that, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.
10. Providing strong references such as character design sheets or other support material is encouraged to make the modeling and revisions process go smoothly.CURRENCY CONVERSIONS AND FEES
11. Customer agrees to pay the total amount specified in USD. EUR is accepted prior arrangement and agreement with the Seller.
12. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller. This includes Paypal service fee if that is chosen as the payment method.
13. Payment is considered as received and completed only when total amount received on Seller's account is equal to the invoice amount agreed before the work started.REFUND POLICY
14. Customer has right to request a full refund if there's been no progress for two consecutive months, when work has not started at all for one month after the initial payment, or when Product has not been completed within five months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work taking longer due to revisions, designs changes, or extras ordered along the way. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
14b.These provisions exclude situations in which the full price payment has not been completed yet or in which payments in installments are too spaced out, as work on Product will develop proportionally to the completed payments.
14c. Sudden cancellation or abandonment without motive from the Customer when work on the Product is or has been conducted normally as arranged, will not guarantee a refund.
15. Customer obliges to contact the Seller in a fast and responsive manner, responding reasonably promptly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.PERSONAL AND COMMERCIAL USE
16. The Product received by Customer is for personal use.
Customer has the right to use the Product for personal work including monetized activities such as paywalled content of any kind, streaming, community supported platforms etc. Any use of the Product for other commercial purposes such as merchandise, reselling it, creating derivative Products has to be notified and agreed beforehand with the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
17. Seller reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.
18. Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.EXCEPTIONS AND SPECIAL CASES
19. When Product is a fanart sponsorship, Customer agrees that no rights to the character or IP can be obtained, and that no exclusive use of the Product can be given. That is, Customer is sponsoring the creation of a publicly (via download or sale on Seller sites) available Product, with rights to input and opinion regarding design choices, outfits and revisions, but nothing beyond that as it is explicitly a different Product situation from that of a normal, private, OC commission.PRIVACY AND OTHER CONSIDERATIONS
20. Unless specifically requested, Seller reserves the right to show, stream, post or otherwise use images of the Product development process for their socials, promotional materials or portfolio. If secrecy is a must, an extra fee may be charged.
21. Once the Product is delivered and already in use by the Customer, privacy can no longer be requested, and the Seller has the right to use any materials of the Product for promotional or portfolio purposes as per section 20.
